Is it true that Hong Kong law allows a woman to kill her husband who cheated on her?

An “interesting fact” about Hong Kong has spread widely on the Internet - supposedly a wife there can kill her unfaithful husband with impunity if she does it with her bare hands. We decided to check if this is true.

Information about Hong Kong's unusual law can be found here. meet on many entertainment portals; sometimes the articles also clarify that you can also kill your mistress, and in this case the weapon of the crime is not important. This law are discussing service users questions And answers, blogging platforms And social networks. This “fact” about Hong Kong is often included in compilations of ridiculous lawsoperating in different countries of the world. Even the media write about a unique legal norm, for example, “Komsomolskaya Pravda", The Voicemag And Marie Claire. This one is popular information and in the English-speaking segment of the Internet.

The punishment for murder, according to laws Hong Kong (section 212 - "Crimes against the person") - this is life imprisonment, and it does not matter whether the person was killed with bare hands or with the help of weapons or improvised objects. There are a number of exceptions: juvenile offenders may receive a shorter sentence, and those who commit murder as a result of an accident or in self-defense will not be punished at all. The law does not contain any reservations regarding situations where the motive for the murder of a spouse was his infidelity.

There are four sections devoted to family relations in Hong Kong law: 178, 179, 181 And 182. They also do not say anything about the wife having the right to kill because of her husband’s infidelity. If the spouse committed adultery and the wife can prove it, this somewhat simplifies the divorce procedure, but that’s all. This also works in the opposite direction - if the wife cheated. There are no fines, prison terms or other sanctions for traitors.

“Verified” could not find any precedents where in Hong Kong a wife would kill her husband out of jealousy and escape punishment. In all cases of such murders known to us (note that they are quite small in number) for the period from 2000 By 2020 year, women were sentenced to life imprisonment, regardless of how they committed the crime. Verified did not find any media reports about the murder of mistresses over the years, but there is no reason to believe that in this case the court would have acted any differently.

Thus, there is not a word in the laws of Hong Kong that a wife has the right to kill her unfaithful husband or his mistress. Any murder other than those committed by minors, accidents or self-defense is punishable by life imprisonment. It was not possible to find precedents when a wife killed her husband for treason and was acquitted.
